Niagara Falls requires a building permit for a deck if any one of four things is true: the deck is bigger than 10 m2 (about 108 sq ft), it is more than 60 cm (23 5/8 in) above grade measured from the top of the walking surface, it is covered or roofed, or it is attached to the house. Meeting any single trigger means a permit is required. Niagara Falls asks for a site plan (1:200 scale, showing lot lines and setbacks), a floor plan, and cross-section/elevation drawings, and requires three inspections: footing/excavation before any concrete is poured, framing, and final. The City's 2026 Schedule of Fees (effective January 1, 2026) charges a "$243.00 Flat Fee" for an uncovered deck or porch and $7.55 per square metre for a covered one, with a "Minimum Building Permit Charge: $243.00". Building without a permit costs "2x Permit Fee". The City lays the process out in three steps on its Decks and Porches page. Step 1 is any agency approval your lot needs. The City's 2026 Deck Reference and Construction Guide says the Niagara Peninsula Conservation Authority must give a clearance review for land next to areas of environmental concern, and Niagara Peninsula Energy must give one where overhead wires are present, "before a permit can be issued". The Niagara Escarpment Commission is on the same list. Step 2 is zoning confirmation: either a simultaneous zoning review with your permit ("no separate application is needed", though the zoning compliance fee still applies) or a separate Zoning Compliance Certificate. Step 3 is the application itself, made in the City's CityView Portal. The Guide says drawings "can be completed by the homeowner, or a qualified designer" and must be to scale on 11 x 17 paper. On inspections, the Guide states the general minimum footing depth of 1.2 m below grade. Framing is inspected before the deck boards go on, unless it can be seen from below, and the final inspection comes before anyone uses the deck. Confirm the current rule directly with Niagara Falls' building department before you build, because the Decks page, the City's Do I Need a Permit page and the Guide do not word the triggers identically.

Zoning By-law 79-200 s.4.14(h) lets a deck project into a required front yard by no more than 2.5 metres and into a required rear yard by no more than 4 metres. No part of it may be closer than 1.5 metres to a street line, or closer to the side lot lines than your zone's minimum side yards. The rule is "subject to section 4.27.1", which adds distance along certain listed roads, and s.4.14 does not apply in the A1, A2, A3, RNP, RV, CH, IW, TCW, OSC and OSPP zones. The by-law's lot coverage definition "does not include decks". The City checks all of this at Step 2, zoning confirmation.
Only if your lot is in an area the Niagara Peninsula Conservation Authority regulates. The City's 2026 deck guide says NPCA must clear permits for land next to areas of environmental concern before the City issues one (NPCA: 905-788-3135). Ontario Regulation 41/24 exempts "an unenclosed detached deck or patio that is 15 square metres or less, is not placed within a watercourse or wetland and does not utilize any method of cantilevering" (s.5(a)(v)). An attached deck, or a bigger one, is not covered by that exemption.
