Only the 10 m2 (about 108 sq ft) footprint threshold comes from the Ontario Building Code Act, 1992's own "building" definition (s.1(1)) and applies the same in every Ontario municipality -- a deck larger than that needs a permit everywhere. The other conditions commonly cited alongside it -- more than 60 cm (about 24 inches) above grade, attached to the house, or covered with a permanent or solid roof -- are set by individual municipal permit-exemption by-laws, not by the Act itself, so a deck generally needs a permit if it clears any one of these. Below all thresholds it is often permit-exempt, but zoning setbacks can still apply either way. A permanent or solid roof over the deck brings the project back into building-permit review (snow-load, wind-load, and setback considerations) even if the open deck underneath would otherwise be exempt; we have not confirmed a Niagara-specific snow-load figure for that review, so we state the principle only. Ontario's Building Code (Part 9, 9.3.2.9.(5)) keys the required treatment to CAN/CSA-O80.1 Use Categories: UC3.2 for above-ground, exposed decking and framing; UC4.1 for anything in contact with the ground, in contact with fresh water, or within 150 mm of finished grade without a moisture barrier -- your posts, and the low framing on a ground-level deck; and UC4.2 for critical structural components. Article 9.3.2.9.(7) requires the wood itself to carry a mark identifying the preservative used and the Use Category it meets, so the end tag on the delivery is something you can actually check, not a guess. Where treated lumber gets cut on site, the cut end has to be field-treated with a site-applied preservative -- a cut end left bare is the one spot the factory treatment never reached. The metal touching that wood matters just as much as the wood itself. A separate Building Code article, 9.23.2.4, sets out what any connector -- joist hanger, post anchor, ledger bolt -- in contact with treated wood has to be: stainless steel, or hot-dipped, zinc-coated galvanized steel rated at least Z550 (also labelled G185), roughly double the coating weight the Code accepts for ordinary outdoor flashing. The fasteners holding those connectors on have their own rule too: ASTM A153/A153M zinc coating, or an equivalent. The only exemption is wood treated with a borate preservative and installed in a fully dry interior environment, which describes no part of an outdoor deck. This article is new: it did not exist in the Ontario Building Code before January 1, 2025, when the province moved to the current edition. Neither the treated-wood grade nor the connector-metal rule is a judgment call, and a builder should be able to point to both on the job.

Cedar sits between the two main options. Its natural oils give it real resistance to rot and insects without the chemical treatment pressure-treated lumber relies on, and it stays a lighter, warmer-looking board. The tradeoffs: cedar is a softer wood, so it dents and scratches more easily under furniture and foot traffic, and left unfinished it weathers to a silver-grey. Keeping its warm colour means a regular cleaning and re-finishing commitment, much like the upkeep a pressure-treated deck carries. Water soaks into the wood, mostly through the board faces, cut ends, and fastener holes, then expands as it freezes. Each cycle pushes small cracks and checks open a little wider, which lets in more water for the next freeze. That is the mechanism behind the maintenance schedule above: a stain or sealer coat is really a moisture barrier, and it matters most at the cut ends and around fasteners, where water gets in first. Composite boards are far less porous, which is why repeated cycles bother them less. Keep in mind, though, that most composite decks still stand on a pressure-treated wood frame underneath, so good drainage and airflow around the structure matter no matter which decking you choose.
